Hendra Case: Progress in Court

LAST week there were developments in the class action case against Zoetis the makers of the Hendra vaccine, with Justice Lee refusing to grant the pharmaceutical company an application seeking orders for their costs to be covered by the participants in the class action.

Justice Lee later granted an application by the class-action to subpoena documents evidencing Zoetis’ claims about their vaccine to third parties including the Australian Veterinary Association, the Equine Veterinarians Australia and veterinarians from Quirindi Veterinary Clinic.

Michael Hyland, from LHD Lawyers, said they believed the application for costs by Zoetis was an attempt to delay the progress of the class action and discourage potential claimants from registering as group members.

“The dismissal of Zoetis’ application for security for costs is a significant positive development in the Class Action,” said Mr Hyland.

“As a result, any owner of a horse negatively affected by the administration of the HeV inoculation should no longer feel intimidated from registering as a group member,” Michael Hyland said.

Zoetis has given notice of their intention to make an application to have the subpoenas set aside.
