Murder Matter Adjourned

JAMIE Cust a 20 year old man from Muswellbrook was mentioned in Muswellbrook local court today charged with the murder of Jesus C. Bebita, a 41 old man from Scone.

Police allege the murder occurred sometime between 3am and 4:15am on December 18 and Mr Cust was apprehended at approximately 6:15am the same day.

Mr Cust worked at JBS in Scone with Mr Bebita.

No application for bail was made and there is an interim order made for a forensic procedure for Mr Cust.

The prosecution said they were concerned at the length of delay for having the procedure, however the Magistrate said he was concerned with granting the procedure only the second day after the release.

“It’s not like television…if we get this wrong…if this was to go pear shaped it could affect the entire prosecution,” said Magistrate Andrew Eckhold.

“As long as the evidence is preserved,” he said.

The Magistrate adjourned the matter of the forensic procedure until February 18, adding if there was a change in the urgency for the test it could be reassessed after January 7 when the court was reopened after the Christmas break.

The prosecution had argued that the matter should be adjourned to Scone local court however the Magistrate asked if Scone court had AVL (audio visual links) and since the Scone court did not have properly functioning equipment, it was adjourned to Muswellbrook on February 18, 2019.
